La inteligencia artificial transforma el derecho. No es solo un modo de facilitar la actividad jurídica. Tiene implicaciones epistemológicas y sociales. El derecho se reduce a datos y a cálculos. Prospera un jurista maquinal. Se empobrece la racionalidad jurídica. Se olvida que la clave del derecho no es el procesamiento de datos sino la creación de sentido.

El antes y un después del comienzo de la guerra de Ucrania muestra los cambios en la opinión de los ciudadanos ante la seguridad y la defensa. No es igual en todos los países de la UE. Habrá que ver si la percepción del riesgo y la forma de hacerle frente se mantiene conforme se alarga la guerra y las consecuencias colaterales. En los gobiernos de la UE existe una cacofonía estratégica semejante a la de los ciudadanos cuando aceptan de (...) manera desigual los costes para garantizar la seguridad colectiva. Una percepción y respuesta desigual como desigual es la realidad de la UE. Las _europas _de la UE dificultan que se realice de manera cómoda los esfuerzos creadores equiparables a los peligros que la amenazan. Esfuerzos tanto en el poder blando, como en el duro. Los líderes estratégicos en la UE al margen de la retórica deben reconocer las amenazas, tomar decisiones políticas y llevar a cabo el esfuerzo continuado para reducirlas. Los ciudadanos del común aportan en número suficiente y por ahora el apoyo en ese sentido. Que en la UE no se desaproveche tanto esfuerzo del pueblo de Ucrania. (shrink)

Background The birth plan is a tool that allows the self-learning and thoughtful analysis of the women during the birthing process, facilitating their making of decisions and participation, in agreement with the bioethical principles of autonomy and no malfeasance. Goal: To understand the perception and satisfaction of women who presented a birth plan. Methodology: Qualitative, descriptive, observational, retrospective and cross-sectional study. The population of the study was composed of 21 women who presented a birth plan regulated in a Hospital ever (...) since the recording of the presentation of the birth plan was started until 2015. Place: Cartagena. Techniques/methods: Semistructured interview. Results-Discussion: Most women considered the plan as a useful self-learning tool on the meaning of the birthing process, as it favored the communication between the expectant mothers/health professionals. Our informants sought information related to the birthing process from informal sources; most perceived a level of respect of their wishes during the process of giving birth. The use of the birth plan did not imply the perception of loss of the degree of control during the birth, although attention to the written document could be improved. Conclusions The use of the birth plan is a very satisfactory and useful experience for their involvement in their self-care, although in some cases, the births did not proceed according to their plans. Nevertheless, the prevalence of the principle of Non-Malfeasance over Autonomy was evidenced. (shrink)

Por tanto, se subraya que no solo es trascendental para la eficacia de una narración la estructura y los ingredientes de ésta, sino también la manera en que se cuenta, el medio utilizado y la plataforma de visualización. The objective of this research is to develop accurate forecasting models for chlorophyll-α concentrations at various depths in El Mar Menor, Spain. Chlorophyll-α plays a crucial role in assessing eutrophication in this vulnerable ecosystem. To achieve this objective, various deep learning forecasting techniques, including long short-term memory, bidirectional long short-term memory and gated recurrent uni networks, were utilized. The models were designed to forecast the chlorophyll-α levels with a 2-week prediction horizon. To enhance the models’ accuracy, a sliding window method (...) combined with a blocked cross-validation procedure for time series was also applied to these techniques. Two input strategies were also tested in this approach: using only chlorophyll-α time series and incorporating exogenous variables. The proposed approach significantly improved the accuracy of the predictive models, no matter the forecasting technique employed. Results were remarkable, with |$\overline{\sigma}$| values reaching approximately 0.90 for the 0.5-m depth level and 0.80 for deeper levels. The proposed forecasting models and methodologies have great potential for predicting eutrophication episodes and acting as decision-making tools for environmental agencies. Accurate prediction of eutrophication episodes through these models could allow for proactive measures to be implemented, resulting in improved environmental management and the preservation of the ecosystem. In this research, a sliding mode regulator with sine mapping is suggested for the stabilization of electricity generators being affected by magnet interaction nonlinearities and generator nonlinearities. To reach this goal, our suggested regulator has the following contributions: it starts from the sliding mode regulator with the modifications that the saturation mapping is used to reach a smoother performance instead of the signum mapping, and the sine mapping is applied to reach an upper bound in the proportional gain error, it (...) is used to reach some chosen constant behaviors for the angle position, angle speed, and current in the electricity generators, and its stabilization is ensured based on the Lyapunov approach. The present study aims to verify the psychometric properties of the Spanish versions of the Social Roles Questionnaire (SRQ; Baber & Tucker, 2006), Modern Sexism scale (MS) and Old-fashioned Sexism scale (OFS; Swim et al. Swim & Cohen, 1997). Enough support was found to maintain the original factor structure of all instruments in their Spanish version. Differences between men and women in the scores are commented on, mainly because certain sexist attitudes have been overcome with greater success in the current (...) Spanish society, while other issues, such as distribution of power in organizational hierarchies or distribution of tasks in the household, where traditional unequal positions are still maintained. In all cases, it was found that men showed greater support for sexist attitudes. The correlations between the three instruments were as expected in assessing sexist attitudes that tend to relate to each other. Eventually, we found no empirical evidence for the postulated link between sexist attitudes and traditional gender stereotypes. Our results call for the validity and effectiveness of the classic theories of gender psychology, such as gender schema theories (Well, 1981; Markus et al., 1982) and the notion of a gender belief system (Deaux & Kite, 1987; 2001). The relationship between John the Baptist and Jesus of Nazareth is defined by most New Testament scholars and historians of Christianity in terms such as “contrast”, “radical difference” or “parting of the ways”. This article aims at reviewing in a detailed way the many phenomenological parallels that the sources permit to establish between these Palestinian preachers of the first half of the 1st century c.e. (a task which has virtually not been made before). i will also reconsider some supposed differences (...) which, according to most scholars, imply the existence of a contrast between them, and i will argue that these differences do not exist or are not important enough to build a contrastive image. in this way, i aim at showing that the idea of a sharp opposition between John and Jesus is an untenable view and the result of a distortion of the available data due to ideological (more specifically, theological) prejudices. In consciousness studies there is a growing tendency to consider experience as (i) fundamentally affective and (ii) deeply interlinked with interoceptive and homeostatic bodily processes. However, this view still needs further development to be part of any rigorous theory of consciousness. To advance in this direction, we ask: (1) is there any affective type that is always present in consciousness?, (2) is it related to interoception and homeostasis?, and (3) what are its properties? Here we analyse and compare Jim Russell's (...) core affect and Thomas Fuchs' concept of vitality, and propose a more encompassing notion that subsumes both: continuous organismic sentience. It provides affirmative answers to questions 1 and 2, and, regarding question 3, a preliminary list of thirteen properties divided into ontological, phenomenological, and functional categories. This is the first of a series of studies that will systematically address different notions of a fundamental, homeostatically-rooted affective type, to achieve a rigorous, unified concept for consciousness science. Esta investigación retoma la obra de Gabriel García Márquez, Noticia de un secuestro (1996), con la volición de cuestionar la idea de Estado nación que está inmersa en el libro. Para ello, es necesario entender que la naturaleza del texto exige un conocimiento amplio al lector o al intérprete, puesto que su contenido revela datos multidisciplinarios. Además, es insoslayable realizar un análisis discursivo de la historia de ese contexto y cotejar con pasajes del mismo libro. Para facilitar esta labor, (...) la extrapolación de conceptos del teórico Luis Rodríguez Manzanera será de utilidad, ya que él despliega definiciones de Criminología, un tema frecuente en la obra. Verbigracia, la macrocriminalidad, una noción que él postula, permite que se comprenda la complexión del periodo histórico finisecular del siglo XX en Colombia, etapa que le corresponde a Noticia de un secuestro. Por otro lado, es menester dilucidar que este estudio no se reduce a lo literario, lo histórico y lo criminológico, sino que abarca distintas disciplinas, por lo que la exigencia en la consolidación epistemológica e interpretativa estará demostrada consuetudinariamente, sin obviar la inmanencia de la obra. Este tipo de análisis interdisciplinarios ya ha sido trabajado desde los Estudios Culturales, tal como se constata en las investigaciones de Richard Johnson (2000) o Néstor García Canclini (1997). De igual modo, el intento de establecer lineamientos y conexiones entre disciplinas como las de Literatura y Derecho ya ha sido desarrollado por Stanley Fish (1986), Faustino Martínez (2005), Carlos Pérez (2006) y Denise Schalet (2014). A diferencia de estos abordajes ya estudiados, el objetivo de esta investigación es detectar y fundamentar cómo se articula una propuesta ideológica desde una configuración que reanuda elementos históricos y literarios. En específico, lo que se busca es argumentar por qué fracasó implícitamente un proyecto sociopolítico de democracia y progreso, a partir de un panorama de violencia, narcoterrorismo, corrupción, negociaciones ilícitas, transgresión a los derechos humanos e inseguridad ciudadana. Con todo ello, esta tesis de maestría terminará siendo fructuosa para análisis postremos de discursos que tienen como esencia un soporte multidisciplinario. (shrink)

This paper studies two of the best-known actresses, Nell Gwyn and Anne Bracegirdle, and the different public personae they created to negotiate their presence in this all-male world. A rigorous cladistic analysis of the dorsal pallium of amniotes indicates that the stem amniote lacked sensorimotor areas. Reptiles apparently acquired a visual cortex by parcellation from the multimodal, hippocampal-like mediodorsal pallium of stem amniotes. The high number of sensory areas of the mammalian isocortex might derive from the specific properties it shows, such as growth-promoting influence on thalamic axons.

Resumen El presente artículo ofrece una interpretación teleológica de la vida consciente y se basa, sobre todo, en la postura fenomenológica de Emmanuel Levinas. Sin embargo, es preciso tener en mente que la fenomenología husserliana está siempre presente como sustrato de ésta. Por ello, a partir de una lectura en que ambas perspectivas se complementan, trazaré un esquema en el que la totalidad de la conciencia se realiza como teleológica y explicaré el papel preponderante que cumple la síntesis en los (...) procesos de constitución para desarrollar los elementos de la ética levinasiana que culminan en una lectura teleológica de la vida consciente. Así, la infinitud con la que Levinas describe el encuentro ético deja de ser sólo una instancia de corte ético-ontológico para describir un momento teleológico.The present paper proposes a teleological interpretation of conscious life based on the phenomenology of Emmanuel Levinas. However, since Husserlian phenomenology serves always as a background for Levinas’s position, I offer a reading in which both views complement each other. First I lay out a scheme in which the totality of consciousness is realized as teleological and then I explain the predominant role played by synthesis in the constitution processes in order to develop the elements of a levinasian ethics culminating in a teleological reading of conscious life. Thus, the infinity with which Levinas describes the ethical encounter ceases to be only an instance of an ethical-ontological dimension to describe a teleological moment as well. (shrink)

The relevance of inner speech for human psychology, especially for higher-order cognitive functions, is widely recognized. However, the study of the phenomenology of inner speech, that is, what it is like for a subject to experience internally speaking his/her voice, has received much less attention. This study explores the subjective experience of inner speech through empathy for pain paradigm. To this end, an experimental phenomenological method was implemented. Sixteen healthy subjects were exposed to videos of sportswomen/sportsmen having physical accidents practicing (...) extreme sports. Immediately after the exposure to the stimuli, a phenomenological interview was conducted to gather data about bodily sensations, emotions, motivations, and inner speech of watching other people’s accidents. Participant’s inner speech expresses concern about the consequences the accident could generate to the sportswomen/sportsmen or about the participants themselves. Simultaneously, participants’ inner speech happened with negative emotional feelings, many sensations distributed throughout their bodies, and a felt knowledge coming from a meaningful but pre-reflective and pre-verbal bodily dimension. Our findings show that inner speech in empathy is not merely a psycholinguistic process or high-order cognitive function, but rather it is a complex experience that occurs deeply related to meaningful emotions, bodily sensations, and an implicit, somatically felt knowledge. Delusions are one of the most classical symptoms described in schizophrenia. However, despite delusions are often emotionally charged, they have been investigated using tasks involving non-affective material, such as the Beads task. In this study we compared 30 patients with schizophrenia experiencing delusions with 32 matched controls in their pattern of responses to two versions of the Beads task within a Bayesian framework. The two versions of the Beads task consisted of one emotional and one neutral, both with ratios of (...) beads of 60:40 and 80:20, considered, respectively, as the “difficult” and “easy” variants of the task. Results indicate that patients showed a greater deviation from the normative model, especially in the 60:40 ratio, suggesting that more inaccurate probability estimations are more likely to occur under uncertainty conditions. Additionally, both patients and controls showed a greater deviation in the emotional version of the task, providing evidence of a reasoning bias modulated by the content of the stimuli. Finally, a positive correlation between patients’ deviation and delusional symptomatology was found. Impairments in the 60:40 ratio with emotional content was related to the amount of disruption in life caused by delusions. These results contribute to the understanding of how cognitive mechanisms interact with characteristics of the task in the context of delusional thinking. These findings might be used to inform improved intervention programs in the domain of inferential reasoning. (shrink)

The DNA‐passage activity of topoisomerase II accidentally produces DNA knots and interlinks within and between chromatin fibers. Fortunately, these unwanted DNA entanglements are actively removed by some mechanism. Here we present an outline on DNA knot formation and discuss recent studies that have investigated how intracellular DNA knots are removed. First, although topoisomerase II is able to minimize DNA entanglements in vitro to below equilibrium values, it is unclear whether such capacity performs equally in vivo in chromatinized DNA. Second, DNA (...) supercoiling could bias topoisomerase II to untangle the DNA. However, experimental evidence indicates that transcriptional supercoiling of intracellular DNA boosts knot formation. Last, cohesin and condensin could tighten DNA entanglements via DNA loop extrusion (LE) and force their dissolution by topoisomerase II. Recent observations indicate that condensin activity promotes the removal of DNA knots during interphase and mitosis. This activity might facilitate the spatial organization and dynamics of chromatin. (shrink)

The Greek word mētis (μῆτις) traditionally refers to a particular form of wily intelligence associated with the arts of deception (dolos) and the knowledge of tricks (kerdē), subterfuges, and traps. Mētis evokes innovative and ground-breaking solutions, based on the capability to understand, anticipate, and possibly violate the others’ expectations. Most importantly, mētis presupposes practical wisdom, or prudence (phrόnesis), a dispositional quality that underpins all the virtues that deserve to be cultivated by sportspersons and that is pivotal to perfect sportspersons’ moral (...) character. Not only is prudence required to apply mētis profitably for winning a game, but it is also indispensable to perform consistently with the game’s norms—cognizant of sport values. This analysis of mētis is key to illuminate the embodied dimension of tactical and moral reasoning in contemporary sport practice. In this paper, we first argue that the strategic effectiveness of mētis proves that not only sensorimotor control but also higher forms of intelligence, like strategic reasoning, are embodied and inform skilful performance; second, we argue that relying on mētis is necessary not only to interpret the rules of the game in one’s own favor but also to respect the shared values that these rules uphold in the sport practice. Respect for human life is central to medicine. In terminal patients, refractory symptoms are a niche of palliative sedation. This paper identi es, based on scienti c evidence, the survival in patients who received palliative sedation as compared to those who didn’t. We conducted a search for systematic reviews from 2000 to 2016, which were methodologically analyzed, and the results were then compared. For methodological reasons, meta-analysis could not be performed. It is concluded that terminal palliative sedation does not shorten (...) patients’ lives. The implementation of the principle of double effect related to the possible shortening of life was reformulated; the unwanted evil is the loss of consciousness. (shrink)

The introduction of mindfulness in the West was carried out through theories and research methods based on the effects that mindfulness practices produce in the brain (information processing and neurobiological activity). Nevertheless, these approaches elude any reference to the core feature of mindfulness, that is, its subjective and intersubjective conscious nature. With the aim of providing a viable scientific proposal to fill this gap, we present the enactive approach as a naturally well-suited explanatory framework to study mindfulness in its full (...) experiential richness, both in its physical and phenomenological attributes. This chapter is organized as follows. First, we argue that the scientific approach to mindfulness has not explained its phenomenological nature, and consider how mainstream cognitive science understands attention and awareness in non-experiential functional terms. In the following section, we dwell with more detail on the meaning and nature of mindfulness and argue for its essentially phenomenological nature. Furthermore, we contend that it comprises not only a subjective dimension but also a relational intersubjective domain. Finally, we present the enactive approach and the neurophenomenological method as a scientific framework to investigate mindfulness as an experiential relational phenomenon constituted by both physical and phenomenological attributes.
